“The Document That Gave New Zealand Independence”

To our fellow New Zealanders from the One New Zealand Foundation Inc.

I have been a researcher for the One New Zealand Foundation Inc since the Foundation was formed in 1988, 25 years ago. Our aim is to unite the people of New Zealand under one flag and one law as intended by those that signed the Tiriti o Waitangi in the first six months of 1840. As each chief signed the Tiriti, at Waitangi, Governor Hobson shook their hand and repeated, “He iwi tahi tatou – We are now one people”.

The ONZF research has always been outside the square, such as researching and finding the Littlewood document was Lieutenant-Governor William Hobson’s final draft of the Treaty of Waitangi, which I explain in my book, “He iwi tahi tatou – We are now one people” written for the ONZF in 1992. I have since written six books for the Foundation, my most recent and radical being, “Colonization – The Salvation of the Maori Race” and “Queen Victoria’s Royal Charter”, material barely, if ever mentioned in other historian’s or Government publications. The Treaty of Waitangi was never “our” Founding Document. It did what was intended in the first six months of 1840 and was then superseded by Queen Victoria’s Royal Charter on the 16 November 1840, which allowed New Zealand to became its own British Colony, with its own Governor and Government under one flag to make and enforce one law for all the people of New Zealand, irrespective of race, colour or creed, but under the watchful eye of the British Parliament.

Over the last 12 months I have researched Queen Victoria’s Royal Charter dated the 16 November 1840. Queen Victoria’s Royal Charter separated New Zealand from the jurisdiction of New South Wales, enacted the Colony of New Zealand, created and established a Legislative Council and an Executive Council, and granted certain powers and authority to the Governor for the time being of the said Colony.

This document has been completely overlooked or deliberately ignored by our leading historians for over 172 years. I have contacted Dr Claudia Orange, Dr Paul Moon and many other leading historians, but they seem uninterested in recognizing Queen Victoria’s Royal Charter as our Founding Document or our First Constitution. Very little, if any mention is made of Queen Victoria’s Royal Charter in any of our history books, although it is displayed in the Constitution Room at Archives New Zealand, Wellington.

The 6th February (Waitangi Day) is not the day New Zealand was founded, it was the day the chiefs gave up their territories and governments to Queen Victoria under the jurisdiction of NSW and in return gave Maori the same rights as the people of England. No more – No less.

Waitangi Day, which was supposed to be a day to unite all the people of New Zealand as one, has been completely hijacked by part-Maori activists by distorting and twisting the Tiriti o Waitangi to benefit this one small group of New Zealand Citizens that claim a minute trace of Maori ancestry but completely overlooks their Pakeha ancestry. Queen Victoria did not have the power or authority (jurisdiction) to give Maori special rights in the Tiriti o Waitangi not already enjoyed by all the people of England under English law. FACT!

While part-Maori have every right to debate the 6th February 1840, the day, “Their chiefs placed in the hands of the Queen of England, the sovereignty and authority to make laws….……It was their chiefs who ceded that right to the Queen. The confiscations [breaches] cannot therefore be objected to in the light of the Treaty” or “If they think these things are wrong, then blame their ancestors who gave away their rights when they were strong”. The Tiriti o Waitangi has nothing to do with Her Majesty’s Subjects as not one signed it; it was an agreement between Queen Victoria and the tangata maori chiefs. Article 2 explaining to Maori, “That the chiefs, the Hapu and all the people of New Zealand would be guaranteed their lands, their settlements and all their property”. Once the Tiriti o Waitangi was signed, New Zealand became British soil; under one flag and one law and all Her Majesty’s Subjects, including Maori inherited the same rights as if living in England (Article 3).

End of negotiations! End of Treaty of Waitangi!

The people of New Zealand are sick and tired of Waitangi Day. They deserve a day to celebrate, to be proud of and to unite our beautiful country as one people under one flag and one law without all the hassles associated with Waitangi Day.

This day should be 16 November “New Zealand’s Independence Day”.

The One New Zealand Foundation Inc would like to see a large monument of Governor William Hobson erected in front of Parliament Building to celebrate and honour “The Founding Father of Our Nation”.
